Terrasse-Vaudreuil — Mise à jour institutionnelle relative à la résolution du 9 juin et au communiqué du 21 août 2026

Le 9 juin 2026, le conseil municipal de Terrasse-Vaudreuil a adopté, à l’unanimité des conseillers présents, la résolution no 2026-06-111, intitulée :

« Engagement municipal pour la protection de la canopée et la reconnaissance des droits fondamentaux de l’Arbre »

La résolution reprend les trois articles de la Déclaration universelle des droits de l’Arbre et reconnaît, dans le contexte municipal de Terrasse-Vaudreuil, les droits à la vie, la croissance naturelle, l’intégrité et la régénération.

Elle prévoit également l’intégration des principes de la Déclaration dans les communications, les politiques de développement, les pratiques de gestion des actifs verts et la modernisation de la réglementation d’urbanisme de la Municipalité.

À la connaissance de La Compagnie des Papillons Bleus et au regard des actes institutionnels recensés à la date de la présente mise à jour, cette résolution constitue le premier acte municipal formel identifié intégrant les trois articles de cette Déclaration précise.

Cette qualification concerne exclusivement la Déclaration universelle des droits de l’Arbre portée par La Compagnie des Papillons Bleus. Elle ne signifie pas qu’il s’agirait de la première reconnaissance de droits de la nature, de la première mesure de protection juridique des arbres ou du premier dispositif territorial en faveur du vivant.

La démarche ayant conduit à la résolution du 9 juin 2026 a été entreprise localement sans contact institutionnel préalable avec Ricardo Rey, auteur et initiateur de la Déclaration universelle des droits de l’Arbre, ni avec La Compagnie des Papillons Bleus, organisation fondatrice et porteuse de la Déclaration.

La Compagnie des Papillons Bleus n’a donc pas été associée, en amont du vote municipal, à la présentation institutionnelle de la Déclaration, à l’identification de son portage officiel ni à la vérification directe des modalités institutionnelles applicables à son développement par les collectivités.

Cette circonstance ne remet pas en cause l’existence historique de la résolution adoptée par le conseil municipal.

Elle signifie en revanche que l’existence de cet acte municipal doit être distinguée de la question de la conformité de la démarche préalable au cadre institutionnel porté par La Compagnie des Papillons Bleus.

Le cadre institutionnel de la Déclaration — entendu notamment comme l’identité de l’instrument, son auteur, son organisation fondatrice et porteuse ainsi que l’existence d’une démarche internationale structurée autour de celui-ci — préexistait à l’initiative municipale de Terrasse-Vaudreuil.

La Déclaration et la démarche internationale dont elle relève ne sont donc pas nées de l’expérience de Terrasse-Vaudreuil.

Certaines modalités institutionnelles ont ensuite été davantage explicitées, harmonisées et documentées publiquement, notamment afin de prévenir les erreurs d’attribution, les confusions de représentation et les interprétations divergentes apparues au cours du développement international de l’initiative.

Cette explicitation plus détaillée ne saurait être assimilée à la création, après le 9 juin 2026, d’une nouvelle Déclaration, d’un nouveau portage institutionnel ou d’un dispositif qui aurait été rétroactivement substitué à celui qui existait auparavant.

Le Cadre officiel en vigueur rassemble aujourd’hui, dans un document public unique, les règles relatives notamment à l’origine, au portage, à la gouvernance, à la représentation, aux usages et aux procédures institutionnelles.

La résolution no 2026-06-111 du 9 juin 2026 constitue la source primaire permettant d’établir avec précision ce que le conseil municipal de Terrasse-Vaudreuil a effectivement décidé.

Elle doit, à ce titre, être distinguée des présentations, commentaires ou interprétations qui ont pu accompagner ou suivre son adoption.

La Compagnie des Papillons Bleus a ultérieurement été conduite à apporter plusieurs clarifications relatives notamment à l’origine de la Déclaration, à son auteur, à son organisation fondatrice et porteuse, à sa représentation institutionnelle et à sa distinction avec d’autres démarches relevant des droits de la nature.

Ces clarifications n’ont pas pour objet de modifier rétroactivement le contenu de la résolution municipale. Elles permettent au contraire de distinguer précisément ce que le Conseil municipal a formellement adopté de ce qui a pu être présenté ou interprété par ailleurs au sujet de la Déclaration et de son cadre institutionnel.

La résolution municipale demeure ainsi le document de référence pour déterminer le contenu exact de l’acte adopté le 9 juin 2026.

Le 21 août 2026, la Municipalité de Terrasse-Vaudreuil a publié un communiqué intitulé « La Municipalité de Terrasse-Vaudreuil réaffirme son engagement envers la nature ».

Dans ce document, la Municipalité annonce qu’elle « se dissocie de la Déclaration des droits des arbres » — formulation exacte utilisée dans le communiqué — et fait référence au « nouveau cadre imposé par la Compagnie des Papillons Bleus ».

La présente mise à jour concerne la Déclaration universelle des droits de l’Arbre visée par cette prise de position municipale.

Le communiqué précise simultanément que cette décision ne remet pas en cause la conviction de la Municipalité concernant la reconnaissance de l’Arbre comme entité vivante méritant respect et protection et annonce son intention de développer une approche plus large portant sur l’ensemble de ses écosystèmes.

La Compagnie des Papillons Bleus conteste formellement la présentation selon laquelle un nouveau cadre institutionnel aurait été créé puis imposé à Terrasse-Vaudreuil postérieurement à la résolution du 9 juin 2026.

La Compagnie distingue, à cet égard, la préexistence de la Déclaration, de son auteur, de son organisation porteuse et de son architecture institutionnelle de l’explicitation ou de la documentation plus détaillée, intervenue ultérieurement, de certaines modalités de fonctionnement.

Cette contestation ne remet aucunement en cause la liberté de la Municipalité de déterminer, dans le respect du droit applicable et de ses compétences, ses propres politiques environnementales, ses modalités de protection des arbres ou ses orientations de gouvernance territoriale.

Elle porte sur la présentation publique de l’origine, de la chronologie, du portage et du fonctionnement institutionnel de la Déclaration universelle des droits de l’Arbre.

Le 2 septembre 2026, La Compagnie des Papillons Bleus a adressé au maire et aux responsables municipaux concernés une demande formelle relative à la qualification de « nouveau cadre imposé » utilisée dans le communiqué du 21 août.

La Municipalité a été invitée à identifier et documenter précisément les éléments factuels et institutionnels sur lesquels elle fonde cette affirmation ou, à défaut, à procéder à sa rectification.

Cette démarche vise à assurer une présentation exacte de la chronologie des événements, du cadre institutionnel de la Déclaration et des responsabilités respectives des différents intervenants.

À la date de publication de la présente mise à jour, cette demande constitue la position formelle communiquée par La Compagnie des Papillons Bleus à la Municipalité sur ce point.

À la date de la présente mise à jour, La Compagnie des Papillons Bleus n’a identifié, parmi les actes officiels municipaux publiquement accessibles qu’elle a examinés, aucun acte subséquent abrogeant, retirant ou annulant expressément la résolution no 2026-06-111.

Il ne serait donc pas juridiquement prudent de présenter le communiqué du 21 août, à lui seul, comme établissant l’abrogation de la résolution.

Terrasse-Vaudreuil n’est en revanche plus présentée comme une collectivité participant actuellement au cadre institutionnel de la Déclaration universelle des droits de l’Arbre, puisque la Municipalité a elle-même annoncé sa dissociation.

La résolution no 2026-06-111 demeure documentée comme un acte officiel adopté par le conseil municipal le 9 juin 2026 et comme un précédent historique et documentaire.

Son éventuelle modification, révocation ou abrogation devra être appréciée à la lumière de tout acte officiel municipal subséquent susceptible d’affecter son statut.

La mise à jour de la situation de Terrasse-Vaudreuil ne consiste ni à effacer le précédent du 9 juin 2026 ni à lui attribuer rétroactivement une portée qu’il n’avait pas.

Elle consiste à distinguer avec précision le fait historique constitué par l’acte municipal, la conformité de la démarche au cadre institutionnel de la Déclaration, la relation institutionnelle actuelle et le statut juridique propre de la résolution municipale.

On June 9, 2026, the Municipal Council of Terrasse-Vaudreuil adopted, unanimously among the councillors present, Resolution No. 2026-06-111, officially entitled in French:

« Engagement municipal pour la protection de la canopée et la reconnaissance des droits fondamentaux de l’Arbre »

An English rendering of that title is: “Municipal Commitment to Canopy Protection and Recognition of the Fundamental Rights of the Tree.”

The resolution incorporates the three Articles of the Universal Declaration of Tree Rights and recognises, within the municipal context of Terrasse-Vaudreuil, the rights to life, natural growth, integrity and regeneration.

It also provides for the integration of the principles of the Declaration into the Municipality’s communications, development policies, green-asset management practices and the modernisation of its planning regulations.

To the knowledge of La Compagnie des Papillons Bleus and on the basis of the institutional acts identified as of the date of this update, this resolution constitutes the first identified formal municipal act incorporating the three Articles of this specific Declaration.

This characterization concerns exclusively the Universal Declaration of Tree Rights stewarded by La Compagnie des Papillons Bleus. It does not mean that this was the first recognition of Rights of Nature, the first legal measure protecting Trees, or the first territorial mechanism for the protection of the living world.

The process that led to the June 9, 2026 resolution was initiated locally without prior institutional contact with Ricardo Rey, author and initiator of the Universal Declaration of Tree Rights, or with La Compagnie des Papillons Bleus, the founding organization and institutional steward of the Declaration.

Accordingly, before the municipal vote, La Compagnie des Papillons Bleus was not involved in the institutional presentation of the Declaration, the identification of its official stewardship, or the direct verification of the institutional procedures applicable to its development by local and regional authorities.

This circumstance does not call into question the historical existence of the resolution adopted by the Municipal Council.

It does, however, mean that the existence of that municipal act must be distinguished from the separate question of whether the process preceding it complied with the institutional framework stewarded by La Compagnie des Papillons Bleus.

The institutional framework of the Declaration — understood in particular as the identity of the instrument, its author, its founding and stewarding organization, and the existence of an international initiative structured around it — predated the municipal initiative undertaken in Terrasse-Vaudreuil.

The Declaration and the international initiative of which it forms part therefore did not originate with the Terrasse-Vaudreuil experience.

Certain institutional procedures were subsequently clarified, harmonised and documented publicly in greater detail, notably in order to prevent errors of attribution, confusion as to representation and divergent interpretations arising during the international development of the initiative.

Such more detailed clarification cannot be equated with the creation, after June 9, 2026, of a new Declaration, a new institutional steward or an institutional mechanism retrospectively substituted for what had existed beforehand.

The current Official Framework now brings together in a single public document the rules concerning, among other matters, the origin, stewardship, governance, representation, use and institutional procedures of the Declaration.

Resolution No. 2026-06-111 of June 9, 2026 constitutes the primary source for determining precisely what the Municipal Council of Terrasse-Vaudreuil formally decided.

It must therefore be distinguished from the presentations, comments or interpretations that may have accompanied or followed its adoption.

La Compagnie des Papillons Bleus subsequently found it necessary to provide several clarifications concerning, in particular, the origin of the Declaration, its author, its founding and stewarding organization, its institutional representation, and its distinction from other approaches associated with Rights of Nature.

These clarifications are not intended to alter retrospectively the content of the municipal resolution. On the contrary, they make it possible to distinguish precisely between what the Municipal Council formally adopted and what may subsequently have been presented or interpreted concerning the Declaration and its institutional framework.

The municipal resolution therefore remains the reference document for determining the exact content of the act adopted on June 9, 2026.

On August 21, 2026, the Municipality of Terrasse-Vaudreuil published a statement entitled « La Municipalité de Terrasse-Vaudreuil réaffirme son engagement envers la nature » (“The Municipality of Terrasse-Vaudreuil Reaffirms Its Commitment to Nature”).

In the original French document, the Municipality states that it « se dissocie de la Déclaration des droits des arbres » and refers to a « nouveau cadre imposé par la Compagnie des Papillons Bleus ». In English, these expressions may be rendered respectively as “dissociates itself from the Declaration of Tree Rights” and “new framework imposed by La Compagnie des Papillons Bleus”.

This institutional update concerns the Universal Declaration of Tree Rights to which that municipal position relates.

The statement also indicates that the decision does not call into question the Municipality’s conviction that the Tree is a living entity deserving respect and protection, and announces an intention to develop a broader approach concerning the entirety of its ecosystems.

La Compagnie des Papillons Bleus formally disputes the characterization according to which a new institutional framework was created and then imposed upon Terrasse-Vaudreuil after the adoption of the June 9, 2026 resolution.

In this respect, La Compagnie distinguishes between the pre-existence of the Declaration, its author, its stewarding organization and its institutional architecture and the subsequent clarification or more detailed public documentation of certain operating procedures.

This dispute in no way challenges the Municipality’s freedom, within the limits of applicable law and its powers, to determine its own environmental policies, Tree-protection measures or territorial-governance priorities.

It concerns the public presentation of the origin, chronology, stewardship and institutional functioning of the Universal Declaration of Tree Rights.

On September 2, 2026, La Compagnie des Papillons Bleus sent the Mayor and the relevant municipal officials a formal request concerning the characterization of a “new framework imposed” used in the August 21 statement.

The Municipality was asked to identify and precisely document the factual and institutional basis for that assertion or, failing that, to correct it.

The purpose of this request is to ensure an accurate presentation of the chronology of events, the institutional framework of the Declaration and the respective responsibilities of the various participants.

As of the date of publication of this update, that request constitutes the formal position communicated by La Compagnie des Papillons Bleus to the Municipality on this issue.

As of the date of this update, La Compagnie des Papillons Bleus has not identified, among the publicly accessible official municipal acts it has examined, any subsequent act expressly repealing, withdrawing or annulling Resolution No. 2026-06-111.

It would therefore not be legally prudent to present the August 21 statement, standing alone, as establishing the repeal of the resolution.

Terrasse-Vaudreuil is, however, no longer presented as a municipality currently participating in the institutional framework of the Universal Declaration of Tree Rights, since the Municipality itself announced its dissociation.

Resolution No. 2026-06-111 remains documented as an official act adopted by the Municipal Council on June 9, 2026 and as a historical and documentary precedent.

Any subsequent amendment, revocation or repeal of the resolution must be assessed in light of any later official municipal act capable of affecting its legal status.
